Wanderport Networks Eswatini
Terms and Conditions

These terms govern the provision and use of internet services supplied by Wanderport Networks Eswatini (Pty) Ltd.

Introduction

This Agreement sets out the complete terms and conditions applicable to the use of internet services provided by WANDERPORT NETWORKS ESWATINI (PTY) LTD, with registered offices in Ezulwini, Eswatini (“Wanderport/Us/We”), by the customer whose details appear in the application form (“Customer/You”), and shall, where the context so admits, include each party’s successors, personal representatives, and assigns.

Services
2.1
The Customer has requested, and Wanderport agrees to provide, internet services (the “Services”) subject to the terms and conditions set out in this Agreement.
2.2
The Customer shall be supplied with the Services based on the preferred package selected in the application form.
2.3
Service provisioning is subject to the Customer’s payment of the applicable fees and successful technical assessment to determine the feasibility of service delivery at the requested location.

Service Activation
3.1
Access to the Service requires payment confirmation and approval of technical feasibility by Wanderport representatives.
3.2
Upon successful assessment, our team will install the service within 48 hours, subject to the Customer granting access to the premises.
3.3
You will receive login credentials for the MyISP customer portal via SMS, email or direct communication. You are responsible for maintaining the confidentiality of your credentials and must not share them with any third party without written approval from Wanderport.

Customer Premises Equipment (CPE)
4.1
Upon installation, and subject to a refundable deposit if applicable, we will provide Customer Premises Equipment (CPE), including but not limited to routers, antennas, POE adapters and mounting hardware.
4.2
Unless the Customer has paid for the CPE in full upfront in accordance with clause 4.3, all CPE remains the exclusive property of Wanderport Networks Eswatini.
4.3
Where the Customer elects to pay the full cost of the CPE upfront, as specified in the Service Order Form, ownership of that equipment shall transfer to the Customer upon full payment. Wanderport-owned CPE provided under any other arrangement remains the property of Wanderport Networks Eswatini.
4.4
You agree to:
  • Grant access to your premises for installation and maintenance.
  • Use the CPE only as instructed.
  • Avoid tampering with, modifying or reverse-engineering the equipment.
4.5
Any damage or loss must be reported to Wanderport immediately. You will be held financially responsible for negligent or unreported loss or damage.
4.6
Risk in the equipment passes to you upon installation. Wanderport will not be liable for damage due to power surges, theft, fire or misuse.

Payments
6.1
The monthly subscription fee is payable in advance every 30 days, as per the selected package.
6.2
A one-time refundable installation deposit may be required, the amount of which is stated in the Service Order Form.
6.3
Non-payment will result in automatic suspension of the service until full settlement is received.
7
Packages and Speeds
7.1
Package details, prices and service specifications are available on www.wanderport.co.sz .
7.2
Speeds are up to the maximum specified, depending on package type (Dedicated vs Shared). Shared packages are subject to a Fair Usage Policy and user contention.
7.3
Wanderport reserves the right to shape bandwidth to maintain optimal network performance for all users.
7.4
No rollover of unused service periods is permitted.
7.5
Package features and pricing may change from time to time and will be published on our website.
8
Service Restrictions
8.1
You may only use the service at the installed location unless otherwise authorized.
8.2
Unauthorized actions include:
  • Sharing service with multiple households or premises.
  • Public redistribution.
  • Use for illegal, harmful or abusive activity.

Suspension or Variation

We reserve the right to suspend the Service:

  • Upon instruction from regulatory or legal authorities.
  • Due to non-payment.
  • For planned maintenance, with reasonable notice.
  • If we detect abuse or breach of contract.

Termination

This Agreement may be terminated under the following conditions:

  • Breach of contract or misuse of service.
  • Regulatory directive to cease service.
  • Customer request, subject to settlement of any remaining contract obligations and term fees.
  • Non-payment or refusal to return equipment.
  • Use of falsified or inaccurate information.

Termination Consequences
11.1
You shall immediately allow Wanderport representatives access to uninstall and recover CPE.
11.2
Deposit refunds, if applicable, will be processed within 30 days, provided all CPE is returned in acceptable condition.
11.3
Any remaining data or unused service will be forfeited upon termination.
12
Special Conditions
12.1
Use of the service is entirely at your own risk.
12.2
Wanderport does not control internet content, nor guarantee protection from viruses or harmful data.
12.3
The Customer is responsible for their own equipment and its compatibility.
12.4
The Customer is responsible for data security, backup and personal online safety.
12.5
Wanderport may rebroadcast service from Customer locations where relevant to improve network coverage.

Liability
13.1
Wanderport will not be liable for:
  • Data loss or service interruptions.
  • Virus infections or software failure.
  • The Customer’s inability to use the service.
  • Indirect or consequential losses.

Service Interruption

We strive to maintain 99% uptime. However, service may be interrupted due to:

  • Weather conditions.
  • Equipment failure.
  • Maintenance or upgrades.
  • National power outages.

Field teams will be dispatched in a timely manner to restore services.

Indemnity

The Customer agrees to indemnify Wanderport against:

  • Third-party claims arising from misuse.
  • Legal or regulatory breaches by the Customer.
  • Unauthorized or illegal usage of the service.

Acceptable Use Policy

You may not use the service for:

  • Fraudulent, obscene or abusive content.
  • Unauthorized reselling.
  • Network disruption or interference.
  • Hosting servers or conducting bulk unsolicited communication.
  • Any activity violating Eswatini laws or international norms.

Data Protection
17.1
We collect personal data to comply with legal and regulatory requirements.
17.2
Your data may be used for service delivery, support and promotional offers.

Our privacy policy is available on our website or via email upon request.

Governing Law

This Agreement shall be governed and construed in accordance with the laws of the Kingdom of Eswatini.

Dispute Resolution

Save as may otherwise be provided herein, all questions in dispute arising between the Parties and all claims or matters in such dispute not otherwise mutually settled between the Parties.

In the event that the parties fail to settle the dispute within fourteen (14) days of the dispute being referred to the parties, the parties shall submit to the courts having competent jurisdiction in Eswatini.

Amendments

Wanderport reserves the right to modify these Terms and Conditions. Updates will be posted on www.wanderport.co.sz and become effective immediately or on the date specified therein.
